The oldest trademark registration in Canada that remains on the register today is for the following design, which was registered in 1866, in association with cigars. The applicant was J.D. King & Co., and the current owner is Rothmans, Benson and Hedges Inc., both of Toronto.
Canada’s Confederation was not until 1867, so this trademark was registered under An Act Pertaining to Trademarks, which predates Canada’s first federal trademark law, the Trade Mark and Design Act of 1868.
In Canada, the letters preceding the registration number denote under which legislation the trademark was registered (ie. TMA868,800 for the current Trade-Marks Act, or TMDA1,000 for the Trade Mark and Design Act). This oldest trademark, ATM127 is not only the oldest registered trademark in Canada, it is also the only remaining trademark from before Confederation and the only remaining trademark with the ATM prefix, for the Act Pertaining to Trademarks.
